CAL-SHAKE
 
CAL-SHAKEŽ is a roofing product that was made from cement and was intended to replace wood shingles as a roof covering. Between l981 and l985 CAL-SHAKEŽ was marketed and sold with a 30 year performance warranty and between 1986 and 1995 with 30 and 50 year warranties. However, owners of the CAL-SHAKEŽ product soon began to discover that the CAL-SHAKEŽ product does not last nearly as long as the manufacturer's warranty states. Instead, only a few years after installation, these owners noticed that the CAL-SHAKEŽ product was rapidly deteriorating, resulting in shakes that crack, split, buckle, cup, warp, and disintegrate. This deterioration in turn led to roof leaks and other consequential property damage. Owners of CAL-SHAKEŽ roofing products have joined together and filed a class action on behalf of themselves and all others similarly injured owners of CAL-SHAKEŽ.
UPDATES
 
  • There is a settlement of litigation concerning cement composite roofing shakes known as "Cal-Shake" shakes. The settlement affects a "class" or group of people that may include you.
  • The class is divided into two groups of class members, called "subclasses."The "New Cal-Shake Subclass" consists of members of the class whose shakes were manufactured by Cal-Shake, Inc. between February 1, 1986 and March 31, 1995. The "Old Cal-Shake Subclass" consists of members of the class whose shakes were manufactured by Shake Company of California, Inc. between January 25, 1980 and January 31, 1986.
  • The Notices to all New Cal Shake Subclass Members have been mailed out to all registered class members. If you have not received a Notice, you can review it, on-line, or if you would like further information, please visit the website at: www.calshakeclassaction.com.
  • The Court granted its final approval of the settlement for New Cal Shake on November 14, 2005. To review a copy of the order, click here: Notice of Entry of Order. All other Notices affecting the New Cal Shake settlement class will be posted at www.calshakeclassaction.com. If you are a New Cal Shake class member, you will need to submit a proof of claim form, and the Claims Administrator, Onni Management, will post the claim forms online at www.calshakeclassaction.com.
OLD CAL-SHAKE LITIGATION DEVELOPMENTS
 
"The Old Cal-Shake Settlement was granted final approval on October 31, 2007. The approved Settlements provide for the creation of a $2.975 million Settlement Fund to be distributed to Old Cal-Shake Subclass Members. The amount you can get depends on the number of people that file a claim and the size of your roof. Payments to Old Cal-Shake Settlement Members out of the Settlement Fund will be made in accordance with the Plan of Distribution that was approved by the Court on October 31, 2007.
Who is Involved in the Old Cal-Shake Settlement Class?
The Class includes all owners of residential and commercial property on which Cal-Shake shakes manufactured by Old Cal-Shake between January 25, 1980 and January 31, 1986 are, or have been, installed. The Class includes property owners who have replaced their Cal-Shake shakes.
