AREAS OF PRACTICE
Tyler Berding, founding partner of Berding & Weil LLP, has represented the commercial and residential real estate industry for more than 35 years. Mr. Berding represents clients in litigation over product and construction failures. The firm has resolved over 700 complex construction-defect claims in California, Florida, Arizona and Hawaii. His special expertise has been in water intrusion, soil failures, failed building systems, and building-product failures. He specializes in representing residential building owners and commercial investors.
LEGAL HISTORY
Mr. Berding founded the law firm of Berding & Weil LLP, along with his partner Steven Weil in 1988. He has participated throughout the years in the development of legislation affecting both commercial and residential real estate issues. He has frequently testified before legislative committees and has served as President of the Executive Council of Homeowners, and as a member of the Calidornia Department of Real Estate's Task Force on Common Interest Developments.

Mr. Berding is a member of the American Bar Association, the State Bar of California and the Common Interest Development Subsection of the State Bar's Real Property Section, the Contra Costa County Bar Association, and Consumer Attorneys of California
He is a member of, and frequently speaks before, such community association organizations as the Executive Council of Homeowners (ECHO), Community Associations Institute (CAI) and the California Association of Community Managers. He served as a member of both the Board of Directors of ECHO and its Legal Resource Panel. He was chair of ECHO's Legislative Committee for nine years and its President for five years.
He was one of the original twenty faculty members in the State for the California Association of Community Managers (CACM) providing certification courses for managers. He is a past member of CACM's Legal Advisory Committee, has been Review Editor of the organization's Law Review, and served as legal adviser to CACM's Legislative Committee.
PUBLICATIONS
Mr. Berding is the author of numerous articles on a wide range of community association issues. These include Latent Liabilities, discussing the impact of latent defects on an association's reserves; No Plan for the Future, about the unique problems facing associations with undeveloped hillside common area and the potentially huge financial impact of land slippage; How to Handle Unexpected Maintenance Needs, concerning the disclosure of and funding sources for unplanned repairs; The Issue of Majority Control, a review of the duties of developers holding a majority interest on an association's board of directors; New Developments in CC&R Enforcement, on how Appellate Court rulings and California statutory law are leading associations to mediation and arbitration of community disputes; the Uncertain Future of Community Associations, on the impact of construction defects on building longevity; The Board's Dilemma and Predictions of the Future from an Uncertain Present, both dealing with the difficulties facing community associations in adequately funding their long and short term obligations to maintain the community. RECOGNITION
Mr. Berding was awarded an "av" rating by Martindale-Hubbell, a national attorney rating service, which he has maintained since 1988. It is their highest rating. He was also selected as a "Super Lawyer" for 2004, 2005, 2006, 2007, and 2008. For 2009 he has been selected as one of two Berding|Weil partners named as one of the top Construction Litigation SuperLawyers in California. He was also recognized as a Top Northern California Lawyer in 2006,2007, 2008, and 2009 by San Francisco Magazine.
