Matt J. Malone

Matt Malone joined Berding & Weil's litigation team in 2005. He represents individuals, homeowners associations, municipalities, businesses and other real estate clients in complex construction defect litigation, both residential and commercial. These cases range from disputes between single-family homeowners and their design professionals to eight-figure settlements involving defective construction of high-rise condominiums. Mr. Malone has also defended homeowners associations in actions brought by their members which have ranged from the more standard claims, such as failure to repair private-use common areas, to more atypical defamation and elder abuse actions.
Mr. Malone also represents clients in class action litigation involving violations of California's unfair competition and consumer protection laws as well as federal truth-in-lending regulations. In addition, he has counseled law firms, attorneys and trustees in multi-million dollar malpractice and breach of fiduciary duty claims, often involving unusually complex underlying transactions.
During law school, Mr. Malone was a law clerk for the California Attorney General's Office as part of its Public Rights Division Honors Program, where he assisted litigation attorneys in the natural resources and environment sections. Mr. Malone has appeared and argued in trial-level courts throughout California at both the state and federal level, as well as the California Court of Appeal.
Mr. Malone received his J.D. from the University of Southern California in 2002, where he received the American Jurisprudence Award for Trial Advocacy and the American Board of Trial Advocates Award for Excellence in Trial Advocacy. He received his B.A., summa cum laude and Phi Beta Kappa, from the University of California, Davis, where he completed a double major in Political Science and English and a triple minor in Latin, Medieval Studies and Sociology.
