Daniel Rottinghaus is a litigation partner and represents commercial and residential real estate clients in construction defect and complex class litigation. A representative list of client representations include, Trinity Properties, The Irvine Company and Irvine Apartment Communities, Olen Residential Realty Properties, The Lurie Company, Shorenstein Realty L.P., ProLogis/Catellus, EAH, Inc. and John Hancock Corporate Realty and numerous homeowner associations. He has also been involved as counsel for the class on many class action cases including, Richison v. Weyerhauser Company, San Joaquin County Superior Court; Carr v. Stimson Lumber Company, Alameda County Superior Court; Blangeres v. Stimson Lumber Company, King County Superior Court, State of Washington; Trinity Properties v. Central Sprinkler Company, United States District Court, Philadelphia, Pennsylvania; The Sutterfield Owners Association v. Tyco International, San Francisco Superior Court; Weiner v. Shake Company of California, Contra Costa County Superior Court; Whitley v. Perfection Corporation, et al., United States District Court, Western District of Missouri; and McAdams v. Monier Lifetile LLC, Placer County Superior Court.
In the past year alone, he has secured over $30 million in recovery on construction defect claims for his clients. In Weiner v. Cal-Shake, Inc., he helped negotiate a $62 million settlement on behalf of homeowners in a roofing product class action; and in the same action against a recalcitrant insurance carrier, he assisted in the trial leading to a favorable jury verdict for homeowners (Weiner v. Shake Company of California, Contra Costa County Superior Court).
LEGAL HISTORY
Partner, Berding & Weil LLP 1995 to present; 1987-1994 U.S. Army Judge Advocate General Corps. (Washington D.C., Japan, Korea, Kansas and Georgia). Special Task Force legal advisor with U.S. State Department (Washington D.C.). Lead attorney for U.S. Army cases involving multi-billion dollar Iranian claims arising from security assistance provided to Iran under the Foreign Military Sales (FMS) program of the United States. Earned Department of State Superior Honor Award in recognition of efforts defending the interest of the United States of America.

He formerly served as a Board Member for the Consumer Attorneys of California (formerly the California Trial Lawyers Association). He was counsel with Trial Lawyers Care, Inc. representing victims pro bono in the World Trade Center 9-11 catastrophe.
