Daniel Rottinghaus is a litigation partner and represents commercial and residential real estate clients in construction defect and complex class litigation. A representative list of client representations include, Trinity Properties, The Sangiacomo Family Trust, Thomas Properties, Shorenstein Realty L.P., and numerous homeowner associations. He has been or is counsel for the class on many class action cases including, Richison, et al. v. Weyerhauser Company, San Joaquin County Superior Court; Carr, et al. v. Stimson Lumber Company, Alameda County Superior Court; Blangeres, et al. v. Stimson Lumber Company, King County Superior Court, State of Washington; Trinity Properties v.Central Sprinkler Company, United States District Court, Philadelphia, Pennsylvania; The Sutterfield Owners Association v. Tyco International, San Francisco Superior Court; Weiner v. Shake Company of California, Contra Costa County Superior Court; Whitley, et al. v. Perfection Corporation, et al., United States District Court, Western District of Missouri.
Recently helped negotiate $62 million settlement on behalf of homeowners in a roofing product class action, Weiner v. Cal-Shake, Inc., Contra Costa County Superior Court; tried to a jury verdict for homeowners a defective roofing product class action, Weiner v. Shake Company of California, Contra Costa County Superior Court.
LEGAL HISTORY
Partner, Berding & Weil LLP 1995 to present; 1987-1994 U.S. Army Judge Advocate General Corps, Washington D.C., Japan, Korea, Kansas and Georgia. Special Task force legal advisor with U.S. State Department. Lead attorney for U.S. Army cases involving multi-billion dollar Iranian claims arising from security assistance provided to Iran under the Foreign Military Sales (FMS) program of the United States.
EDUCATION HISTORY
Received Juris Doctor in 1987 from Santa Clara University School of Law.
Received Masters degree in Law in 1993 from Georgetown University School of Law and as an officer in the U.S. Army studied military law at the University of Virginia. Bachelor of Science degrees in Engineering and Political Science from the University of California at Los Angeles.
